Contracts & Dispute Resolution for Non Lawyers

This is a two day course for people that come into contact with contracts and disputes everyday but who do not have a legal background. Learn how to make sense of all that legal jargon and help solve your own issues.

Potential Participants:

Project Managers, Engineers, Human Resource Consultants, Accountants and any other professionals that come into contact with contracts, including those from the Construction Industry, Government Agencies and Enterprises.

Areas will include:

CONTRACTS (Detailed notes and examples will be provided)

  • Impact of law on the life cycle of a contract
  • Preparation
  • Negotiating the contract
  • Drafting the contract
  • Completion
  • Dealing with anticipatory or actual breach

COMMERCIAL DISPUTE RESOLUTION (Workshop format)

  • What does the contract say about Dispute Resolution processes?
  • What is the dispute about?
  • What do you want to do (negotiate, mediate or terminate)?
  • Exploring possibilities: Rights based or Interest based
  • Selecting the right process


Class numbers will be limited for each student to obtain the maximum out of each session.

Presenters:

SUSAN CARR-GREGG - has had a long career background in legal education and professional training in major City firms, at Macquarie University and at the College of Law. She has served on various Law Society Committees and Disciplinary Tribunals, and is a specialist in Commercial Law and Contracts. Susan is a current senior lecturer at UTS.

MARILYN SCOTT - a practising solicitor, mediator and academic. Marilyn coordinates the UTS programs in Dispute Resolution and Collaborative law. Marilyn is also the Vice-President of Collaborative Professionals (NSW) Inc, a not-for-profit organisation promoting the new developing Collaborative Practice.

Other academics and practitioners will also be participating.
